Terms of Service

Welcome to Kacha Focus. These Terms of Service (“Terms”) govern your use of the mobile application and related features (the “App”) provided by Zhangqin, an individual developer (“we” or “us”). By using the App, you agree to these Terms.

1. The Service

Kacha Focus is a personal focus and productivity app. It lets you turn photos into visual focus stickers, run focus and break timers, organize focus history, record a feeling you choose, optionally display and control supported music playback, play bundled ambient sounds, and create images or videos to share.

Some features require a compatible Apple device, an internet connection, a paid Pro entitlement, third-party services, or optional permissions. Features and availability may change as the App develops.

2. Eligibility and Responsible Use

You must be legally permitted to use the App and to agree to these Terms. If you use Kacha Focus on behalf of an organization, you confirm that you have authority to bind that organization.

You agree not to:

Use the App for unlawful, abusive, fraudulent, or harmful purposes.

Attempt to bypass security, payment, entitlement, or usage restrictions.

Reverse engineer, disrupt, overload, or interfere with the App or its services except where applicable law expressly permits it.

Upload or share content that infringes another person’s privacy, intellectual property, or other rights.

Use the App in a way that violates Apple, Spotify, or another connected service’s terms.

3. Your Photos and Content

You retain ownership of photos, stickers, collection names, and other content you create or select in Kacha Focus.

You grant Kacha Focus a limited permission to process that content only as needed to provide features you choose, such as subject extraction, display, local storage, optional iCloud synchronization, and creation of shareable images or videos.

You are responsible for ensuring that you have the rights and permissions needed for content you capture, import, or share. Kacha Focus does not claim ownership of your content.

4. Device Permissions and Connected Services

The App may request optional access to the camera, selected photos, add-only Photos saving, notifications, Apple Music, Spotify, and iCloud. Declining a permission limits the related feature but does not prevent use of other available features.

Apple Music, Spotify, iCloud, and the App Store are operated by their respective providers under their own terms and availability. We do not provide or sell music. Spotify connection may be limited by Spotify's account, developer-access, and service rules; we cannot guarantee that every user can connect.

5. Focus Records and Exports

Focus times, completion status, and any feeling you select are productivity records, not medical assessments. You decide whether to save or share an image or video created in the App. Check an export before sharing it, especially if it contains your photo, focus history, or music information.

6. Purchases and Kacha Focus Pro

The App offers a monthly auto-renewable subscription, an annual auto-renewable subscription, and a one-time non-consumable purchase for Pro access, where available. The features, local price, billing period, and any trial shown on the purchase screen govern the offer you select. An introductory free trial is available only when Apple determines that you are eligible and the offer is configured for that product.

For subscriptions:

Apple charges your Apple account when the purchase is confirmed or when an applicable trial ends.

The subscription renews automatically unless you cancel it at least 24 hours before the end of the current period. Renewal may be charged within the 24 hours before that period ends.

You can manage or cancel the subscription in your Apple account settings. Deleting the App does not cancel it.

The one-time Pro purchase does not renew and remains associated with the purchasing Apple account under Apple's rules. It grants access to supported Pro features in this App for the lifetime of the App; it is not a promise that a service or particular feature will operate forever. Eligible purchases can be restored using Restore Purchases. Apple handles billing, refunds, and purchase disputes under its policies. Changes to paid features remain subject to applicable law and Apple's purchase rules.

7. Intellectual Property and Third-Party Credits

The App's software, interface, branding, original artwork, and documentation belong to the developer or their licensors and are protected by applicable intellectual-property laws. Third-party names and trademarks remain the property of their owners. Your rights to third-party materials follow their respective licenses.

Bundled sounds

The App includes ambient recordings from Mixkit under the Mixkit Sound Effects Free License. The recordings have been converted to AAC with a short loop crossfade; the audio may not be redistributed as a standalone sound-effects pack. UI sound cues from the UI SFX “zen” pack are supplied under the CC0 1.0 public-domain dedication. These third-party assets remain subject to their own license terms.

8. Service Availability and Changes

We aim to keep Kacha Focus reliable, but we do not guarantee uninterrupted or error-free operation. Features may be modified, suspended, or discontinued to maintain security, comply with law, respond to platform changes, or improve the product.

You are responsible for maintaining appropriate backups. Optional iCloud synchronization is a convenience and is not guaranteed to prevent every form of data loss.

9. Disclaimer

To the maximum extent permitted by law, Kacha Focus is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted availability.

10. Limitation of Liability

To the maximum extent permitted by law, the developer will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, goodwill, or productivity arising from use of the App.

Where liability cannot be excluded, total liability will be limited to the greater of the amount you paid for Kacha Focus during the 12 months before the claim or the minimum amount required by applicable law. Consumer rights that cannot legally be waived remain unaffected.

11. Suspension and Termination

You may stop using Kacha Focus at any time. We may suspend access to connected or paid features if reasonably necessary to address fraud, abuse, security risks, legal requirements, or a material violation of these Terms.

Termination does not automatically cancel an App Store subscription. Subscriptions must be managed through your Apple account settings.

12. Changes to These Terms

We may update these Terms as the App changes. The “Last updated” date will identify the latest version. Where required, we will provide additional notice. Continued use after an update takes effect means you accept the revised Terms.

13. Worldwide Availability and Local Rights

These Terms are intended to apply wherever the App is made available. Your mandatory consumer rights and other non-waivable protections under applicable local law remain unaffected. Nothing in these Terms selects a court or removes a right that local law does not allow us to remove.
